Employers should make sure that they are using the most current version of the I-9 form when hiring new employees. The current version is dated 3/8/13. Newly hired employees must complete and sign Section 1 of the Form I-9 no later than the first day of employment. Employers must complete Section 2 of the form within 3 business days of the employee’s first day of employment. Additionally, employer’s have the responsibility of examining the document or documents provided as proof of identity and employment authorization. Failure to comply with the instructions for Form I-9 can result in civil and/or criminal penalties.
The Department of Homeland Security governs the I-9 (Employment Eligibility Verification) process and may conduct occasional audits to confirm compliance. Penalties range from $110 per form violation for first offense up to a maximum of $1,100 per form violation for the third offense. Hiring or continuing to employ a person knowing they are not authorized to work in the United States has higher penalties associated with this violation.
